From the desk of Luis Hestres, Families USA

Families USA is part of a large national coalition that will soon launch the Campaign for Children’s Health Care: A national campaign

to educate the public, opinion leaders, and decision-makers about the need to expand health insurance coverage to all children.

According to the U.S. Census Bureau, more than nine million children in the United States have no health insurance. These

children are at risk of experiencing irreparable health and developmental problems that could diminish their educational opportunities.

As part of this effort, we are collecting stories of uninsured children. As you may know, we maintain a database of health care stories

from all over the country. This story bank is often used by reporters, policymakers, and others to help put a human face on complicated

health policy issues and news stories.

We are interested in hearing from families:

bulletWho can't afford health insurance for their children
bulletWhose children face serious health consequences because they are uninsured
bulletWho have seen their children’s academic achievement compromised because they are uninsured
bulletWho experience difficulties providing insurance for their children due to financial hardships
bullet

If you or anyone you know would like to share a story, please contact Aman Gohal, Communications Associate, toll-free at

1-800-593-5041 ext. 3621. Health care consumers may also share their story online via this link. Stories can also be e-mailed to storybank@familiesusa.org.

Families USA respects the privacy of consumers and asks for their permission before sharing their stories with anyone.

To learn more or to distribute information about our story bank, please view our brochure. Health care consumers can fax the story

form on the last page of the brochure to 202-347-2417.

We appreciate your assistance in helping us put a human face on the many uninsured children in our health care system.

Voters and Disability, Civic and Civil Rights Groups Challenge State's Vote Plan in Court

Plan Completely Fails to Uphold Bold New Statutory Voter Rights to

Remedy the Loss of Votes and Other Problems in Past Elections

Today in Albany, a group of voter-eligible citizens -- which includes individuals with various disabilities and limited-English-proficient Asian American voters – joined a broad coalition of disability, civic and civil rights organizations in filing a motion to intervene in the lawsuit brought by the Department of Justice against New York State and its election officials.  These individuals and organizations seek an injunction requiring the State to comply with the Help America Vote Act (HAVA) and interrelated New York law, to submit an effective compliance plan with the court, and to ensure a legal implementation process that will vindicate the rights of all eligible voters, including those with disabilities and limited English proficiency.

Enacted by Congress in 2002, HAVA is essentially a voters’ new "Bill of Rights" and remedy for problems that surfaced in the 2000 presidential elections. Four to six million voters did not have their votes counted across the country in that year; large numbers lost the opportunity to vote due to problems in the registration process; limited-English-proficient voters were often denied the option of a provisional ballot; and 21 million voters with disabilities did not cast a vote. Among its provisions, HAVA required that by 2006 all voters have the right to vote independently and with privacy and that every polling place have improved voting machines that are fully accessible for voters with disabilities and comply with additional protections such as those under the Voting Rights Act.  To avoid the loss of the right to vote, the law also mandated voter registrations systems capable of producing accurate voter rolls for Election Day.

In filing suit against New York, the Justice Department chastised the State for its "abject failure" to comply with these and other HAVA provisions.  It went on to add that New York "until recently categorically failed to take even the most rudimentary steps toward HAVA compliance."

Nevertheless, the groups charged that the Justice Department has now taken a very limited view of what the State must do to improve its elections, ignoring major elements of the Help America Vote Act and New York law that create new individual voter rights and indeed denying that such rights were enacted in HAVA. They contend that the intervention of voters who have experienced real problems at the polls, including voter-eligible citizens with disabilities and limited English proficiency -- and groups that represent them - is essential for vindicating the individual voter rights enacted on their behalf and on behalf of all voters. The citizens and groups further stated that they offer invaluable experience, expertise and insights for helping craft an effective plan that will remedy long-standing election problems in New York and for assisting the court in overseeing the successful implementation of such a plan.

The groups are moving to intervene in a federal court case first filed last March.  They are the American Council of the Blind of New York; The New York State Independent Living Council; The Catskill Center for Independence; Chinatown Voter Education Alliance; Young Korean American Service and Education Center; and the New York Public Interest Research Group.  The individual plaintiff-interveners include voters with limited physical dexterity, sight impairments, Chinese and Korean voters with limited English proficiency, and a registered voter who experienced difficulties in voting at his polling place due to failings of the voter registration system.  The legal organizations providing representation to various plaintiffs in the case are AALDEF, NYLPI, and NVRI, together with private pro-bono counsel Proskauer Rose, LLP.

OMB Watch

--PLEASE CIRCULATE--

Tell your Senators: Concentrate on America's Priorities, Stop the Estate Tax Give-Away

Majority Leader Bill Frist (R-TN) wanted to hold a vote to repeal the estate tax last fall. Because of Hurricane Katrina, however, the Senate's calendar was too full -- and, well, a give-away to heirs of multimillion-dollar fortunes that would add a trillion dollars to the deficit was pretty unseemly at the time. Now that enough time has passed, Frist's back at it, promising to schedule a vote that will "kill the death tax forever."

Here's the sneaky part: Frist knows he doesn't have the 60 votes for full repeal of the estate tax, so what he and his anti-tax allies will do is push for so-called "reform" legislation. Sen. Jon Kyl (R-AZ) has put forward a plan that would effectively gut the estate tax, saving the ultra-rich millions and slashing funds available for addressing America's needs. Though they bill it as a compromise, it's really a plan for backdoor repeal.

TAKE ACTION TODAY!

Full repeal would cost us nearly $1 trillion over the first ten years. With everything our country now faces -- the national debt, trade deficits, soaring energy costs, rising healthcare costs, unmet education needs, homeland security, etc., etc., etc. -- why on earth would a tax break for the rich be on a priority for the Senate now?

It could be that some pretty powerful families stand to win big from repeal. Eighteen families in particular, owners of such American mainstays as Wal-Mart and the Campbell's Soup Co., have been pouring millions into the campaign for repeal--chump change compared to the upwards of $71.6 billion they'll save if the tax is repealed (see Spending Millions to Save Billions).

Repeal would amount to the Senate handing a check -- on behalf of low- and middle-income American families and future generations of taxpayers -- for tens of billions of dollars to a few incredibly lucky heirs.

Use our online email tool to urge your Senators to:

  1. Oppose a vote on repeal of the estate tax bill; and
  2. Oppose any reform that does not preserve a major portion of the estate tax revenue. This includes Kyl's proposal.

For more reasons why estate tax repeal is a bad idea, see our estate tax talking points.

Dear Colleague,

On behalf of the Centers for Disease Control and Prevention (CDC), I am pleased to announce that a new fact sheet, “Victimization of Persons with Traumatic Brain Injury or Other Disabilities: A Fact Sheet for Professionals” is now available.

Victimization can include physical violence, sexual violence, psychological or emotional abuse, and neglect, and research indicates that persons with disabilities are at an increased risk for victimization.

This fact sheet was developed for professionals to provide a comprehensive overview of the topic of victimization of persons with TBI or other disabilities and to raise awareness about this serious and preventable public health problem.

To view or download the fact sheet, visit CDC on the Web at: http://www.cdc.gov/ncipc/tbi/FactSheets/VictimizationTBI_FactSheet4Professionals.htm.

Yes! I oppose discrimination in the Constitution

I am writing today as your constituent to voice my opposition to the discriminatory Federal Marriage Amendment (FMA).

This amendment would forever write discrimination into the United States Constitution. The Constitution was written to protect and ensure equality for ALL Americans. This amendment would destroy that equality by rewriting the Constitution to treat same-sex couples differently than other Americans.

Please vote against the FMA and defend the principles of freedom and equality in our Constitution.

Reminder: Please do not engage with anti-gay protesters if protesters are present.

Due to today's Fargo visit of a handful of anti-gay Westboro Baptist Church members from
Kansas protesting the funeral of a local National Guard soldier, we wish to make a
statement and recommendation.

We are saddened by the disrepect the anit-gay and anti-American group showed to the the
local soldier's family, the armed forces, all GLBT persons, and all Americans.

If their presence in Fargo incites protesters at Pride events,
we wish to recommend the following actions:

We ask that if you are approached by any protesters
1)  Do not engage them in conversation; don't give them your name or any other personal information.
2)  Keep physical distance between them and you.
3)  Inform one of the local Pride organizers that protesters are present.
4)  Enjoy PRIDE. This is your weekend.

If the anti-gay group happens to stay in Fargo-Moorhead over the weekend,
be aware that they are experts at manipulating confrontation. This group
has been known to use protest lines and hateful signs to intimidate, draw public
attention and instigate verbal and/or physcal interactions. It is reported that they
love to file frivolous lawsuits and get out-of-court settlements.
Please do not engage with them!

The Pride Collective and Community Center's mission is to support the GLBT community of
Fargo-Moorhead and Red River Valley. As a sponsor of Pride and head of the Pride Planning
Committee, we wish to keep the Pride events fun and safe.

Happy Pride!

The Pride Collective and Community Center Board of Directors
